1. ELIGIBILITY
Sweepstakes open only to residents of the 50 United States, District of Columbia and Canada (except the Province of Quebec) who are 18 years of age or older. Employees and directors of American Park Network ("Sponsor" or " American Park Network "), their parents, affiliated and subsidiary companies, advertising and promotion agencies, partners, judges and legal advisors, and the immediate family or members of the households of such employees and directors are not eligible.
Void where prohibited by law.
2. PROMOTIONAL PERIOD
To enter, follow these directions. Sweepstakes begins 6/01/09 and entries must be received by 12:00pm on 3/15/10 to be eligible to win. To be eligible to win this Sweepstakes, your entry must be received by the date specified above.
3. ENTRY
Entries submitted via mail or electronically to the website in accordance with these rules will be eligible for consideration.
To enter by mail, send a 3"x5" card in black or blue ink hand print your full name, complete home address including zip code, home telephone number with area code, date of birth, gender, e-mail address, and in the upper right hand corner of the card, your home phone number (including area code) followed by your first, middle and last initials and mail in a first class stamped #10 envelope to: APN Earth Day Every Day Challenge, Columbus Circle Station, PO Box 20113, New York, NY 10023. Limit 1 entry per person. This information may also be submitted typewritten on an 8.5” x 11” sheet of white paper.
All other mail-in entries are void.
APN Media LLC and their parent, subsidiary or affiliate companies, shall not have any obligation or responsibility with regard to (i) entries that contain inaccurate information or do not comply with these rules, (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer or technical error of any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, or (iv) any damages or losses of any kind caused by any prize or resulting from acceptance, possession or use of any prize. Sponsors, in their sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of this website or otherwise violating these rules. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events outside Sponsor's control compromise the integrity or viability of the promotion, Sponsor reserves the right to void the entries at issue, modify the promotion and/or terminate the relevant portion of the promotion.
4. DRAWING
From all eligible entries received, APN Media LLC will randomly select the winners on or about March 30, 2010. Canadian entrants drawn will be required to correctly answer a skill-testing question in order to be eligible to win. Winner will be notified by phone and postal mail on or about June 1, 2010. Winner will be obligated to complete, execute and return an Affidavit of Eligibility, a Release of Liability and a publicity release within 14 days of notification. Failure to timely return documents, or if prize notification or prize is returned as non-deliverable, or if winner is found not to be in compliance with these Official Rules or otherwise ineligible, may result in disqualification with an alternate winner selected.
5. GENERAL CONDITIONS
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or website; to be in violation of the Terms of Service of the website; to be acting in violation of the Official Rules; to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Any attempt to deliberately damage any website or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the sponsor reserves the right to seek damages or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
Selection of winners is under the supervision of APN Media LLC whose decisions are final.
Sweepstakes subject to all federal, state and local laws and is void wherever prohibited by law.
Canadian residents, to win, must first correctly answer, unaided, a time-limited mathematical skill testing question administered by mail.
Any prize or prize notification returned to APN Media LLC as undeliverable may result in the awarding of that prize to an alternate winner. By acceptance of a prize, winner, or in the case of the grand prize, winner and the winner's travel companion consent to the use of their names, photographs or other likenesses, testimonials and other biographical information for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of APN Media LLC without further compensation, unless prohibited by law. Submission of entry constitutes permission for APN Media LLC to use entrant's email address and other submitted information for purposes of marketing and promotion subject to APN Media LLC privacy policies. All entries become property of sponsor and will not be returned.
6. CONSUMER DISCLOSURE/PRIZES/ODDS
PRIZES: One (1) GRAND PRIZE: An Carbon-free National Park Vacation for four. The prize includes airfare for four people, two hotel/lodge rooms for four days and three nights and a rental car voucher for $250.00. Approximate Retail Value of Grand Prize: $2500.00. Fifty (50) first prizes: SYLVANIA Compact Flourescent ENERGY START® qualified, energy-efficient light bulbs. Approximate Retail Value of First Prize: $25.00. All other expenses and all federal, state and local taxes, are winner's sole responsibility. Certain travel restrictions may apply. Travel by winner and companions must be from same point of origin. Trip must be completed by 12/31/10. No transfer or substitution of prize(s) except at the sole discretion of APN Media LLC.
7. LIMITATIONS OF LIABILITY
Sponsor is not responsible for late, lost, illegible, misdirected, stolen, undelivered, separated, or postage due entries or mail, and Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to its web sites. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof.
Sponsor is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by website users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site.
In no event will sponsor, or their parents, affiliates, subsidiaries and related companies, their advertising or promotion agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of internet site www.AmericanParkNetwork.com or the downloading from and/or printing material downloaded from said site.
